Association Health Plans (“AHPs”)

The Trump Administration recently released a proposed rule pertaining to AHPs. As expected, the rule broadens the definition of “employer” under the Employee Retirement Income Security Act (“ERISA”) by relaxing the existing “commonality of interest” standard to allow unrelated employers to band together to purchase insurance for their employees, presumably at a lower cost. The proposed rule reflects the Administration’s attempt to fulfill President Trump’s promise to allow insurance companies to sell insurance across state lines.
