Miners’ Pension Relief

Senate Majority Leader Mitch McConnell (R-KY) recently announced his support for S. 2788, a bill that would provide additional funding for the United Mine Workers’ of America (“UMWA”) pension plan. The legislation, sponsored by West Virginia Senators Joe Manchin (D) and Shelley Moore Capito (R), would reallocate certain environmental clean-up funds set aside under the Surface Mining Control and Reclamation Act of 1977 and make U.S. Treasury transfers to the pension plan. The recent announcement was spurred in part by the October bankruptcy filing of Murray Energy, which currently accounts for 97% of the annual employer contributions to the pension plan.
